11-2-04
REPUBLICAN RIVER MEETING REPORT:
The Negotiating Committee has presented a draft Integrated Management Plan to DNR and are waiting to hear back on any comments from DNR.
Owens moved to go into executive session for approximately 30 minutes to discuss the phone conversation between Upper Republican Negotiating Committed and DNR officials that transpired on October 20, 2004 and to have the Board, Legal Counsel and the Manager present. Executive session is necessary for the protection of public interest and to protect the reputation of individuals.

REPUBLICAN RIVER MEETING REPORT:
The Negotiation Committee sent a draft Integrated Management Plan to DNR in October and it has been reviewed by DNR and sent back to the NRD. The Negotiation Committee will have a phone conference with DNR later in the week to discuss their comments.

Terryberry moved to go into executive session to discuss the Attorneys comments on the proposed Integrated Management Plan for a period of up to 45 minutes with the Board, Legal Counsel and Manager present. Seconded by Owens.

The Board reviewed the handout on Information to be considered in formulating and adopting Integrated Management Plan. The Board and Manager and Legal Counsel discussed the procedure for establishing a stakeholders group. The Board would need to advertise a meeting and stakeholders can have direct input for the IMP.
• Kuenning moved to have a Public Hearing on the Scientific Data and other
Information that will be considered in Developing an Integrated Management Plan and to have a Public Hearing on the Integrated Management Plan on March 3, 2005 and a stakeholders meeting on the afternoon of March 1, 2005 at the Imperial Community Center with the Management and staff setting the time. Seconded by Martin. Discussion. Roll call vote: 11-yes. Motion carried.
• Terryberry moved to go into executive session for a period of 45 minutes to discuss the draft Integrated Management Plan with the Board, Manager and Legal Counsel present due to this information being privileged and confidential from Legal Counsel. Seconded by Martin. Roll call vote: 11-yes. Motion carried.
The Board went into executive session at 10:44 p.m.
• Owens moved to come out of executive session. Seconded by Martin.
Roll call vote: 11-yes. Motion carried. The Board came out of executive session at 10:45 p.m.
• Terryberry moved to make a draft of the Integrated Management Plan with changes available on February 9, 2005. Seconded by Bernhardt.
Roll call vote: 11-yes. Motion carried.
• Terryberry moved that the information to be considered in adopting the Integrated Management Plan available by February 9, 2005 and also the proposed Rules and Regulations changes. Seconded by Kuenning.
Roll call vote: 11-yes. Motion carried.
3-28-05
RULES AND REGULATIONS:
The Manager reviewed the purpose of the meeting. After the public hearing on the Integrated Management Plan and the Rules and Regulations the Department of Natural Resources asked the URNRD to make a few changes on definitions to comply with the compact settlement agreement. There were some changes to the Integrated Management Plan that the Ground Water Committee recommends also. With these changes DNR felt the URNRD should hold a public hearing on the new changes of the Integrated Management Plan.
The Manager reviewed the changes to the draft IMP and the Rules and Regulations. There was discussions with the Board members on the changes on the draft IMP.
· Large moved to present the draft document at the Public Hearing on April 28, 2005 with the changes presented on March 28, 2005. Seconded by Owens.

· Owens moved to go into closed session for approximately two hours to specifically discuss the strategy of negotiations with Department of Natural Resources with respect to the Integrated Management Plan. Seconded by Large.

· Owens moved to amend the main motion to include Board Members, Legal Counsel and Management present. Seconded by Kuenning.
Roll call vote: 11-yes. Amendment carried.
· The motion now reads: to go into closed session for approximately two hours to specifically discuss the strategy of negotiations with Department of Natural Resources with respect to the Integrated Management Plan to include Board Members, Legal Counsel and Management present.
Roll call vote: 11-yes. Amended motion carried.
Steve Smith representing Water Claim formally objected to the Board going into executive session.

REPUBLICAN RIVER MEETING REPORT:
The Manager and Attorneys had a conference call with Department of Natural Resources concerning the negotiations of the IMP. The Manager and legal counsel would like to review the negotiations and potential changes of the IMP and also review Legal Counsels suggestions.
• Martin moved to go into executive session for a period not to exceed one hour to discuss the IMP negotiations with Department of Natural Resources with the Board, Manager and Legal Counsel present. Seconded by Schilke.
Roll call vote: 9-yes, 2-absent. Motion carried.
The Board went into executive session at 9:47 p.m.
• Large moved to come out of the executive session. Seconded by Martin.
Roll call vote: 9-yes, 2-absent. Motion carried.
• Martin moved to approve the Upper Republican NRD and the Department of Natural Resources draft IMP dated April 28, 2005 for Public Hearing. Seconded by Large. Roll call vote: 9-yes, 2-absent. Motion carried.
